By placing an order through this website, the customer confirms that they have read, understood and accepted these Terms of Sale.
2. Prices and VAT
All prices shown on the website are in Euro (€) and, unless otherwise expressly stated, include Italian VAT at 22%.
Shipping costs, where applicable, are shown separately during the checkout process before the customer confirms the order.
DEA S.R.L.S. reserves the right to change prices at any time. However, products will be invoiced at the price displayed on the website at the time the order is placed.
3. Scope and Application
These Terms of Sale govern the offer, transmission and acceptance of purchase orders for products on the Sanisplit websites operated by DEA S.R.L.S.
Customers are invited to read these Terms of Sale carefully before placing an order and to save or print a copy for future reference.
4. Orders and Conclusion of the Contract
All purchase orders must be completed in full and must contain all information necessary for the correct identification of the customer, the products ordered and the delivery address.
After the customer submits an order, an order confirmation email acknowledging receipt of the order will be sent to the email address provided by the customer.
The sales contract is concluded only when DEA S.R.L.S. accepts the order and sends confirmation of acceptance and processing.
DEA S.R.L.S. reserves the right to refuse incomplete, inaccurate, abnormal or suspicious orders, as well as orders in the event of product unavailability, pricing errors or other legitimate reasons.
If an order cannot be accepted, the customer will be informed as soon as reasonably possible. Any payment already received for unavailable products will be refunded.
5. Product Availability
All products are offered subject to availability.
If, after an order has been placed, a product becomes unavailable, DEA S.R.L.S. will inform the customer as soon as possible. In such case, the customer will be entitled to a refund of any amount already paid for the unavailable product.
6. Payment Methods
Customers may pay using the payment methods available at checkout.
For persons or companies not resident in Italy, payments are accepted only by bank transfer or by credit/debit card through secure third-party payment providers such as PayPal or Stripe.
Payment information is processed directly by the relevant payment service provider and is not stored by DEA S.R.L.S.
7. Delivery
Unless otherwise specified, delivery is made to street level.
Delivery times shown on the website are indicative only and may vary depending on stock availability, destination and courier operations. For most products, delivery within European Community countries generally ranges from 3 to 10 working days, except where express courier services are selected and available.
DEA S.R.L.S. shall not be liable for delivery delays caused by force majeure or by events beyond its reasonable control, including but not limited to production delays, supplier delays, transport disruption, customs delays, courier issues, strikes, severe weather or other unforeseen events.
Customers are advised not to schedule installation works, plumbing works, renovation works or similar activities before the purchased goods have actually been delivered.
8. Inspection Upon Delivery
Upon delivery of the goods by the courier, the customer must check:
- that the number of packages delivered matches the shipping documentation;
- that the packaging is intact and not visibly damaged, altered or wet.
If the packaging is visibly damaged or if there are missing packages, the customer should sign for the delivery with reservation and specify the issue in writing on the courier’s proof of delivery.
Any visible transport damage, missing items or packaging anomalies should be reported to DEA S.R.L.S. as soon as possible after delivery, preferably within 48 hours, together with photographs where available.
Failure to make an immediate reservation with the courier may make claims against the courier more difficult, but it does not affect the customer’s mandatory statutory rights.
If the courier is unable to deliver due to the customer’s absence, incorrect address or failure to collect the goods, the shipment may be placed in storage. Any additional storage, redelivery or return costs caused by the customer may be charged to the customer.
9. Shipping Costs
Shipping costs are shown during the checkout process and are calculated according to the destination, weight, volume and total value of the goods.
For deliveries outside Italy, shipping costs may vary depending on the geographical area of delivery and the characteristics of the shipment.
For deliveries outside the European Union, any customs duties, import taxes or local charges, where applicable, are the responsibility of the customer unless otherwise expressly stated.
10. Right of Withdrawal for Consumers
If the customer is a consumer purchasing online, they have the right to withdraw from the contract within 14 days from the day on which they, or a third party designated by them, receive the goods, without having to provide any reason.
To exercise the right of withdrawal, the consumer must send a clear written communication to DEA S.R.L.S. before the withdrawal period expires.
The goods must then be returned without undue delay and in any event within 14 days from the date on which the consumer communicated the withdrawal.
Unless otherwise agreed, the cost of returning the goods in case of withdrawal is borne by the consumer.
The consumer is liable only for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
If the withdrawal is validly exercised, DEA S.R.L.S. will reimburse the payments received for the returned goods in accordance with applicable law and may withhold the refund until the goods have been received back or until the consumer has supplied evidence of having sent them back, whichever occurs first.
11. Exclusion of the Right of Withdrawal for Business Customers
The right of withdrawal described above applies only to consumers.
If the purchase is made by a company, professional, sole trader, legal entity or any person acting for purposes related to a business, trade, craft or profession, the statutory consumer right of withdrawal does not apply.
12. Exceptions to the Right of Withdrawal
The right of withdrawal does not apply in the cases excluded by applicable law, including, where relevant, goods made to the customer’s specifications or clearly personalised.
13. Legal Guarantee for Consumers
Consumers are entitled to a legal guarantee of conformity of 2 years from the date of delivery of the goods.
If a product is defective, damaged due to a lack of conformity, or does not match the contract, the consumer may be entitled, depending on the circumstances and applicable law, to repair, replacement, price reduction or refund.
To make a claim under the legal guarantee, the customer must contact DEA S.R.L.S. and provide proof of purchase, a description of the issue and, where reasonably requested, photographic evidence or other supporting documentation.
The legal guarantee applies only where the product has been used correctly and in accordance with its intended use and any instructions provided.
14. Warranty for Business Customers
If the purchase is made by a company or business customer, the commercial warranty period is limited to 1 year, unless otherwise expressly agreed in writing.
Business customers are not entitled to the consumer legal guarantee regime reserved by law to consumers.
15. Assistance and Non-Conformity Claims
In the event of an alleged lack of conformity, the customer must contact DEA S.R.L.S. before returning any product.
DEA S.R.L.S. may request information, photographs or other evidence in order to assess the issue and may provide instructions for return, inspection, repair or replacement.
If, following inspection, the reported issue is found not to be due to a lack of conformity or defect attributable to the seller, any inspection, transport, handling or return costs may be charged to the customer, where permitted by applicable law.
16. Limitation of Liability
DEA S.R.L.S. shall not be liable for indirect or consequential loss, delays or failure to perform due to events beyond its reasonable control.
Nothing in these Terms of Sale excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
17. Governing Law and Consumer Protection
These Terms of Sale shall be governed by Italian law.
However, if the customer is a consumer residing in another country, they shall also benefit from any mandatory provisions of the law of the country of their habitual residence that cannot be derogated from by contract.
18. Jurisdiction
If the customer is acting as a consumer, any dispute shall be subject to the jurisdiction provided by applicable consumer protection law.
If the purchase is made by a business customer, any dispute arising out of or in connection with these Terms of Sale shall fall under the exclusive jurisdiction of the Court of Viterbo, Italy.
